Engagement can improve requirements, reveal market capacity and reduce barriers. It can also give one organisation information, access or influence that others do not receive. The risk depends on timing, subject matter, participant selection, information exchanged and the procurement that may follow.

Market Accord applies the controls below whenever a buyer challenge may relate to a public procurement or competitive private process. Authority-specific legal advice and internal governance remain the buyer's responsibility.

Minimum controls

Before, during and after engagement

The record should be sufficient for someone not present to understand what happened and how fairness was protected.

Before

  • Declare procurement status and decision.
  • Map affected market segments.
  • Check conflicts and connected parties.
  • Use neutral, comparable questions.
  • Define confidential and publishable information.

During

  • Keep a record of participants and information exchanged.
  • Avoid live bid coaching or undisclosed one-to-one advantage.
  • Give reasonable accessibility and response opportunity.
  • Separate source fact from opinion.
  • Escalate material new information.

After

  • Record themes, disagreement and decisions.
  • Publish relevant common information where appropriate.
  • Mitigate participant advantage.
  • Preserve sufficient time for the wider market.
  • Retain records under the buyer's governance.

Separation from Bid Champions

Development insight must not become hidden bid intelligence.

  • Market Accord buyer work will not disclose confidential buyer thinking to Bid Champions bid teams.
  • Bid Champions will not use Market Accord participation to imply preferred access or buyer endorsement.
  • A participant in a buyer challenge will not receive unpublished help that changes competition.
  • Market Accord will not publish a supplier-specific quality judgement generated from preliminary engagement.
  • Where staff or interests overlap, the conflict and mitigation are recorded.
